The short version: we sell listing space. We don’t sell horses, we’re not part of any sale, and we can’t vouch for any horse or seller. Buyers and sellers deal directly with each other, at their own risk. A listing costs $150 once, stays up until the horse sells, and isn’t refundable once it’s published.
1. Who we are and what these terms cover
The Saddlebred Exchange (“the Exchange,” “we,” “us”) is a website where sellers pay to advertise Saddlebreds — and the horses and ponies shown alongside them — for sale, and buyers browse those listings for free. These terms apply to everyone who uses the site — buyers browsing listings and sellers with an account. By using the site, you agree to them. If you don’t agree, please don’t use the site.
2. We sell listing placement — nothing more
What you pay for is a place to advertise your horse on the Exchange. We are not a party to any horse sale. We don’t broker sales, handle payment for horses, hold deposits, arrange vettings, transport, or transfers of registration, and we don’t take a commission. Any deal is entirely between the buyer and the seller.
3. No warranties about horses or sellers
We don’t inspect horses, verify registration papers, show records, health, soundness, temperament, ownership, or anything else a seller says. We don’t screen buyers or sellers. Listings are written by sellers, and we provide the site “as is,” without warranties of any kind.
Buyers and sellers transact entirely at their own risk. Do your own homework: ask for a pre-purchase exam, check papers, talk to people who know the horse, and use a payment method you trust.
4. Your account
- You need an account to list a horse. Give us accurate information and keep your password to yourself — you’re responsible for what happens under your account.
- You must be at least 18 (or the age of majority where you live) to create an account or list a horse.
- Tell us right away at sammc@thesaddlebredexchange.com if you think someone else has accessed your account.
5. Listing fees
- A listing costs a one-time fee of $150 (US dollars), paid through Stripe when you publish. Promo codes may lower the price.
- A listing stays live until the horse sells (or you or we take it down). There are no renewals or monthly charges. Edits are free.
- The fee is non-refundable once your listing is published. If something goes wrong with a payment before your listing goes live, contact us and we’ll sort it out.
- We may change our prices for future listings. Changes never affect a listing you’ve already paid for.
6. What sellers promise
When you list a horse, you confirm that:
- You own the horse, or you’re authorized by the owner to sell it.
- Everything in your listing — name, breeding, age, sex, price, photos, video, show history, description — is accurate and not misleading, and you’ll keep it up to date (including marking it Sale Pending or Sold).
- You have the right to use the photos and video you upload.
- The horse is actually available for sale.
So that a paid listing can’t be reused for a different horse, the barn/show name, registered name, year foaled, sex and breed lock once a listing goes live. If one needs correcting, email us.
7. Content you post
You keep ownership of your photos, video and text. By posting them, you give us permission to display, resize, and share them on the site and in places that promote your listing (for example, link previews and social posts), for as long as the listing is up and for a reasonable time after.
8. Rules and removing listings
Don’t use the Exchange to post anything fraudulent, misleading, or unlawful; list a horse you can’t sell; scrape or copy the site’s content in bulk; harass other users; or interfere with how the site works.
We may remove or hide any listing that we believe is fraudulent, misrepresents the horse, or breaks these rules, and we may suspend accounts that do. If we remove a listing for one of these reasons, the fee is not refunded.
9. Limits on our liability
To the fullest extent the law allows, the Exchange isn’t liable for any loss arising from a horse sale, a listing, contact between users, or your use of the site — including indirect or consequential losses. If we are found liable for anything, our total liability is limited to the amount you paid us for the listing involved. You agree to cover any claims against us that arise from your listings or your dealings with other users.
10. Changes to these terms
We may update these terms as the site grows. When we make a meaningful change, we’ll update the date at the top and give notice on the site or by email before it takes effect. Continuing to use the site after that means you accept the new terms.
11. Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Florida.
